Terms of Service

These Terms of Service ("Terms") govern your access to and use of Dono (the "Platform") as a creator/streamer ("you"). By creating an account and completing onboarding, you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility

• You must be at least 18 years old and legally able to enter a contract.
• You must provide accurate, current, and complete information during signup and onboarding, including identity (PAN), bank, and channel details, and keep it updated.
• You are responsible for safeguarding your account credentials and for all activity under your account.

2. Account Approval & KYC

• Every streamer account is subject to review and manual approval by our team before it can receive tips.
• You authorise us to collect and verify your PAN, legal name, and bank details for identity verification (KYC), tax compliance, and payouts.
• We may refuse, suspend, or revoke approval at our discretion, including where information cannot be verified or a violation is suspected.

3. Tips & Payments

• The Platform is used solely to receive tips given by viewers to support your livestreams. Payment processing is provided only for such livestream tips and not for the sale of any goods or services.
• Tips are voluntary payments made by viewers to you through our payment processor (Razorpay). They are not payment for any specific good or service and are generally non-refundable once completed.
• You must not offer or promise illegal, regulated, or prohibited goods, services, or benefits in exchange for tips.
• We are not a party to the transaction between you and your viewers and are not liable for viewer conduct, chargebacks, or disputes.

4. Platform Commission

Dono charges a commission on each tip, set per streamer and shown in your dashboard. The commission is deducted at the time of each tip; the net amount is credited to your available balance. We may change the commission with notice.

5. Settlements & Payouts

• You may request payouts of your available balance, subject to a minimum threshold. Payouts are processed to your verified bank account and may be reviewed before being released.
• You are solely responsible for the accuracy of your bank details. Payouts to incorrect details are your responsibility.
• You are responsible for all taxes on your earnings. We may withhold tax (e.g. TDS) and report amounts where required by law.
• We may delay, hold, or reverse payouts in cases of suspected fraud, chargebacks, violations, or legal/regulatory requirements.

6. Acceptable Use & Conduct

You agree that you will not, and will not permit others to:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
• Post or solicit content that is illegal, sexually explicit involving minors, hateful, harassing, defamatory, deceptive, or that infringes others' rights.
• Engage in fraud, money laundering, self-tipping, fake transactions, or any scheme to evade fees, taxes, or detection.
• Impersonate any person or misrepresent your identity, affiliation, or channel ownership.
• Attempt to disrupt, reverse engineer, scrape, overload, or gain unauthorised access to the Platform.

7. Your Content

You retain ownership of the content you provide (display name, bio, avatar, alert media, messages). You grant Dono a non-exclusive, worldwide, royalty-free licence to host, store, display, and transmit that content as needed to operate the Platform (including overlays and public tipping pages). You are responsible for ensuring you have the rights to any media you upload.

8. Suspension & Termination

We may suspend or terminate your account, withhold or reverse funds, and remove content if you breach these Terms, if required by law or our payment partners, or to prevent fraud or harm. You may stop using the Platform at any time; provisions that by their nature should survive (payments owed, liability, indemnity) will survive termination.

9. Disclaimers & Limitation of Liability

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Dono and its operators are not liable for any indirect, incidental, or consequential damages, or for loss of earnings, data, or goodwill. Our total liability for any claim is limited to the commission we earned from your account in the three months preceding the claim.

10. Indemnity

You agree to indemnify and hold Dono harmless from claims, losses, and expenses arising from your use of the Platform, your content, or your breach of these Terms or applicable law.

11. Governing Law

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of India.

12. Changes

We may update these Terms from time to time. Material changes will be notified, and continued use after changes take effect constitutes acceptance.
